Tuan joined Russin & Vecchi in 1992 and has been involved almost exclusively in intellectual property matters.

He assists international companies to register their intellectual property assets in Vietnam, including trademarks, patents, copyrights and licensing.

He is well experienced in enforcement of IP rights. He has experience in the investigation and conduct of raids on counterfeiters.

He assists clients to negotiate with domain name owners to buy out domain names. He has been involved in several landmark IP rulings on behalf of clients.

Deals

  • Trademark, patent, industrial design, and copyright registrations, including registrations for clients such as Burger King, Tetra Pak, Fila, Amway, Qualcomm;
  • Opposition to applied marks and cancellation of registered marks that are confusingly similar to clients’ marks, such as Burlington Industries and Fender Musical Instruments Corporation;
  • Worked on an unnamed American chipmaker and others, to have trademarks recognized as “well-known” in Vietnam;
  • Investigation and organization of raids on patent and trademark infringers. Advised successfully on a complex and novel matter involving an infringed patent of a new substance/new method;
  • Assist clients to prepare and register technology transfer and licensing agreements and software development, distribution, and licensing agreements. Registration of trademark licensing agreement for Hyatt Corporation. Registration of technology transfer agreement for Jotun A/S, Amway Corporation;
  • Work with Customs regarding illegal importation of products that infringe trademarks and patents;
  • Domain name infringement, successful negotiation on behalf of infringed owners.
